In this Privacy Statement (‘statement’): 

The Town means the Town of Port Hedland (ABN 19 220 085 226). 

The Town' website means www.porthedland.wa.gov.au, www.porthedlandleisure.wa.gov.au,  www.mattdann.com.au,  and any other websites operated by the Town of Port Hedland.   

User means a person who uses www.porthedland.wa.gov.au, www.porthedlandleisure.wa.gov.au,  www.mattdann.com.au or any other Town of Port Hedland websites.  

This statement provides information regarding the use of the Town’s websites and the privacy of its users and their information. The Town values the privacy of its customers and stakeholders and manages the privacy risks of the information it collects about them. 

There are risks associated with the transmission of data through the internet. Users should make their own judgement of the potential risks when deciding to use the Town’s website.

The Town collects information about its customers and stakeholders: 

  • In the performance of its services and functions

  • Through correspondence, communication and service requests from customers and stakeholders; and

Generally, when users submit information to the Town, the Town uses that information to respond to their correspondence or service request.

Site data collected 

Town may also collect information on how you use our websites and other personal preferences. Other information that may be automatically collected when you visit our websites include (without limitation) your Internet Service Provider, operating system, browser information, IP address or other device identifiers, location and time/date stamp.

All our emails are sent in line with the guidelines set out by the Australian Communications and Media Authority and we will only send you content that is customised to your interests, characteristics or general location. 

As with all email marketing from us, there will always be an unsubscribe button or link located at the bottom of the email. With this, you can manage which messages you receive from us.

All financial details and online payments are securely managed by a PCI DSS compliant partner through a payment gateway that’s designed in accordance with the highest levels of data protection and security practices mandated by the international financial industry.

Third Parties and Service Providers 

The Town may engage one or more third party companies as service providers and sub processors for the purposes of conducting and/or carrying out the day-to-day business and administrative activities of the Town. 

Third parties contracted by the Town are and will continue to be contractually obligated to keep your personal information confidential and secure. 

Other Channels 

To the extent permitted by law, unless otherwise specified, by engaging in communications with the Town of Port Hedland, inclusive of but not limited to, in-person, email and phone, consent is provided for the use and disclosure of the information for the purposes of the request/statement, or a closely related purpose which would reasonably be expected. 

User Contributions 

Submissions made by the public, directly, or through related systems may become, and remain public. We welcome open discussions and all expressions of opinion that are respectful of others and their views.

The Town of Port Hedland makes no representation as to information accuracy or validity, and expressly, to the maximum extent permitted by law, disclaims all liability in relation to user comments and contributions. 

Use and Disclosure 

When the Town collects personal information the owner of that information will be informed of the reason for collecting their information and how it will be used. When personal information is collected it will be used only:  

  • for the primary purpose for which it was collected; or  
  • for a secondary purpose that is directly related to the primary purpose; or 
  • with the owner’s consent; or 
  • where required or authorised by law; or  
  • where there is a serious threat to the life, health, safety or welfare of an individual; or  
  • where illegal activity may have occurred  

The Town will not use or disclose personal information unless it has considered the kind and amount of information, if it is necessary for business functions and activities, the risk of loss or harm, if it is in the public interest, if it is in the best interests of a child and if it meets the objectives of the Privacy and Information Sharing Act 2024.  

A written record will be kept where personal information was collected for a primary purpose and has been used for a secondary purpose or disclosure.  

Disclosures outside Australia 

The Town will not disclose anyone’s personal information, including de-identified information, outside Australia unless it is lawful, the recipient of the information operates under law which makes them compliant with these principles, with the individual’s consent, forms part of a contract, or for the benefit of the individual.  

Data Security 

We take active steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure, and against other misuse.  

Access, Correction and Removal 

Under the Privacy and Responsible Information Sharing Act 2024 (WA) and the Freedom of Information Act 1992, you have the legal right to request access, correct and/or amend your personal information. You may also request access to, and the correction of, your personal information to which Information Privacy Principle 6 applies, under the PRIS Act. 

At the Town of Port Hedland, we do everything we can to keep your personal information accurate.

The Town may provide, on this site, links to Web sites operated by other entities. If you use these sites, you will leave this site.
