Special Council Meeting - Wednesday 15 June 2022

At the Special Council Meeting held on Wednesday 15 June 2022, Council voted to revoke Council Decisions CM202122/001, CM202122/002 and CM202122/003 made at the Special Council Meeting on 11 May 2022.

As of Thursday 16 June 2022, Council will not be applying to the Supreme Court of Western Australia, pursuant to Order 56 of the Supreme Court Rules 1971, for judicial review pertaining to the measures endorsed at the Special Council Meeting on 11 May 2022. 

Following Council's decision to revoke the endorsed measures, Mayor Carter acknowledged the community's views on a complex and personal subject.

"Since the Special Council Meeting held on 11 May 2022, Council received further legal advice which advised that the passed resolutions may be beyond the powers (ultra-vires) of the Town.

"I was concerned about the potential unknown cost to ratepayers by undertaking the proposed actions.

"I understand and respect the diversity of views when it comes to mandates and public health measures. With this outcome, I look forward to the Town re-focusing on the core business of local government in delivering quality services and infrastructure to support our community."
